Litigation
is the term used to describe the process whereby one party ("the
Plaintiff") brings a claim ("proceedings") against another party
or parties ("the Defendant(s)") which is heard in open court and
decided upon by a judge. Solicitors advise clients on the viability
or likelihood of success of such claims and handle the litigation
/ proceedings on their behalf.

Claims
can be brought in the District, Circuit or High Court. The Supreme
Court deals with appeals from decisions of the High Court. While
solicitors normally handle District Court cases on their own, barristers
are usually involved in the drafting of proceeding and the presentation
of the case in the Circuit and High Courts.

Where
necessary, the assistance of barristers ("Junior / Senior Counsel")
is availed of and they are usually involved in Circuit, High and
Supreme Court cases. The expertise of the firm, which is unusual
in Ireland, is such that it has regularly dealt with cases in the
Circuit, High and Supreme Courts without the need to involve Counsel.

The
restriction on the value of claims that can be dealt with in these
Courts is as follows: District - IR£5,000.00, Circuit - IR£30,000.00,
and there is no limit on the jurisdiction of the High Court.
