Arbitration is a process whereby parties agree to refer the matters in dispute between them to the decision of a person who will arbitrate between them. The arbitrator will be chosen by the parties or is nominated by someone to whom the parties give the power of nomination.

As someone who is a Fellow of the Chartered Institute of Arbitrators and who has acted as an arbitrator and mediator for many years, Bill Holohan has seen arbitration, not only from the perspective of a party to an arbitration but also from the perspective of the arbitrator.

The Arbitrator will usually be chosen for their expertise or knowledge of the particular area or matter or nature of the dispute, example, building matters, travel vehicles etc.

Dispute Resolution is the term used to describe alternatives to Arbitration or Litigation, such as Mediation, where, rather than adjudicating as between the parties, an attempt is made to bring them to an agreed solution to their differences.

 

This gives him a singular advantage when advising clients on how to maximise their position and resolve their difficulties to their best advantage through arbitration or other forms of dispute resolution. He has also been honoured by being the first solicitor in Ireland to be invited by the International Arbitration Forum to become a member of their International Arbitration Forum Panel.

In 2002, Bill Holohan was requested by the Private Residential Tenancies Board to act as a mediator on their behalf in relation to private residential tenancy issues.
